Repair.dental Privacy Policy

PLEASE READ THIS AGREEMENT CAREFULLY AS IT CONTAINS IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS. THESE INCLUDE, BUT ARE NOT LIMITED TO, VARIOUS LIMITATIONS AND EXCLUSIONS, AND INDEMNITIES.

  • 1. Requesting Services
    • 1.1 As a Requesting User, by confirming your Request, you understand and agree that you have made an offer, for which a Dentals Professional has the power to accept or reject in his or her sole discretion. Once you have confirmed your Request, you may cancel the job without incurring a fee only before such time that the Professional has departed his or her current location for the Premises.
    • 1.2 You further acknowledge and understand that the first Service Professional who accepts your Request for a Service on the terms of your Request may be the Service Professional to perform the Service. You understand that once a Service Professional accepts your Request, we will notify you with information which may include the Service Professional's name, and estimated time of arrival. You will also be able to contact the Service Professional by telephone or text message for the sole purpose of communication related to the Service Request.
  • 2. Your Responsibilities
    • 2.1 By making a Request, you represent and warrant that you have the right to grant the Service Professional access to the Premises to perform the Services, will be present at the Premises or will have a representative who is present at the Premises at all times while the Service is being performed.
    • 2.2 When interacting with other Users, including Service Professionals, you should exercise due diligence, caution and common sense to protect your personal safety and property. Neither Dentals nor our affiliates or licensors are responsible for the conduct, whether online or offline, of any user of the service and you hereby release Dentals and our affiliates or licensors from any liability related thereto, whether direct or indirect. Dentals and our affiliates and licensors will not be liable for any claim, injury, or damage arising in connection with your use of the service.
  • 3. Parts
    • 3.1 Dentals will provide Parts for equipment covered in an applicable Service Contract, subject to Parts availability. Dentals may provide new or reconditioned Parts. Replaced parts and assemblies shall become the property of Dentals upon removal. For Parts installed by Dentals, title and risk of loss transfers to Customer upon installation. For Parts ordered by and shipped to Customer, title and risk of loss passes to Customer upon shipment
  • 4. Fees & Payment Terms
    • 4.1 Minimum Charge. You understand and agree that there is a minimum charge set for each Service. We reserve the right, in our sole discretion, to apply the Minimum Charge for your Job, other than as provided for herein. You understand and agree that we may apply the Minimum Charge to the Job if the Service Professional arrives at the Premises prior to any cancellation and within the grace period as set out in the Guidelines. If we choose to apply the Minimum Charge, we may consider the cost of materials separately from our determination of whether to apply the Minimum Charge.
  • 5. Service Payment and Billing
    • 5.1 Requesting Users will be responsible for paying the invoice for each Service, which will include the pricing terms of the Service agreed to between the Requesting User and the Service Professional. By submitting a Request, you agree that you will pay for all Services requested (including all materials, taxes and late fees, as applicable, unless otherwise provided in this Agreement. You understand and agree that we will be responsible, in our sole discretion, for determining the Service Payment amount and any agreement you make directly with the Service Professional regarding payment will not apply. The Service Payment amount will be largely based on the information the Service Professional provides us.
    • 5.2 We reserve the right, in our sole discretion, but are under no obligation to place a hold on any Service Payment. If your payment does not go through, for any reason, you agree to pay the Service Payment amount due within seven (7) days of us sending the Invoice or receipt. You may be charged a cancellation fee or minimum payment if you book or confirm a Service Request but cancel it before the Service is completed as set out in the Guidelines. You further agree that you are responsible for the timely payment of all Service Payments and that any such Service Payment made is non-refundable, unless otherwise determined in our sole discretion.
    • 5.3 We reserve the right to introduce or charge a service fee or implement charges for features of the Service as indicated to Users from time to time. Any revised fees will take effect 30 days from the date of posting to the Website.
  • 6. Prohibited Activities

    Trust is a critical element of the Service. While using the Service, you agree not to:


    • 6.1 if you are a Requesting User, submit a Request that you do not intend to have completed by a Service Professional or that you do not intend to pay for
    • 6.2 recruit or otherwise solicit any User or Service Professional to join third-party services or websites that are competitive to Dentals or to use our Services to obtain work or Services outside the provision of our Service, or
    • 6.3 use the Service to "stalk", harass, threaten, intimidate, harm, cause a nuisance to, annoy, or inconvenience any other User of the Service or collect or store any personally identifiable information about any other User other than for purposes of transacting a Service.
    • 6.4 While using the Service, you further agree not to request, offer, negotiate, or complete any portion of a Home Service that:
    • 6.5 would violate, or lead to the violation of, any applicable local, provincial, territorial, national or international law or regulation,
    • 6.6 encourage or facilitate illegal activity
    • 6.7 you have no legal right to request or perform.
  • 7. Warranty
    • 7.1 For Service Products, Dentals warrants to Customer that
      (a) it will perform the Services in a timely, competent and professional manner and in accordance with industry standards and
      (b) the Services shall conform to the Service Contract for a period of 24 hours from completion. Dentals further warrants to Customer that any Parts
      (i) shall be free of any liens,
      (ii) shall, for a period of 90 days from installation if installed by Dentals, be free of material defects in workmanship and material.
    • 7.2 For Equipment Installation, Dentals warrants to Customer that (a) it will perform the Services in a timely, competent and professional manner and in accordance with industry standards and (b) the Services shall conform to the Service Contract for a period of 24 hours from completion of the Services or, if Dentals performs the final equipment connections, 30 days from completion of the Services. Delays in equipment startup shall not extend this warranty.
      • 7.2.1 The above warranties apply directly to Customer and may not be assigned. The Warranty does not apply to defects caused by accident, misuse, neglect, improper installation, unauthorized alteration or repair or improper testing by Customer or a third party. Customer's sole remedy, and Dentals sole liability, for a breach of the Warranty regarding Services is for Dentals, at its option, to re-perform the Services, repair or replace the Parts, or credit Customer's account for such defective Services or Parts. Dentals obligations herein are contingent upon
        (i) Customer making any claim under this warranty within 90 days of Dentals performance of the Services or shipment of any Parts,
        (ii) such claim includes detailed explanation of any alleged deficiencies,
        (iii) Dentals is given a reasonable opportunity to investigate all claims; and
        (iv) Dentals examination of such the Part or Service confirms the alleged deficiencies and that the deficiencies were not caused by accident, misuse, neglect, improper installation, unauthorized alteration or repair or improper testing by Customer or a third party.
  • 7. Amendments
    • 7.1 We reserve the right to change, modify, add, or delete portions of this Agreement in our sole discretion from time to time without further notice.
